Brenna litigates patents, trademarks, copyrights, and trade secrets in a range of technologies including medical devices, mechanical innovations, consumer goods, and software. She also prosecutes patents on consumer goods, wireless technology, and medical devices, and represents her clients in licensing negotiations as well. Her litigation experience confers a key advantage to her prosecution and licensing practice, and her judgment, combined with a thorough understanding of her clients’ business priorities, helps ensure that their legal dollars are spent efficiently.
Brenna was admitted to practice in the state of Oregon in 2000, the USPTO in 2002, the Federal Bar for the District of Oregon in 2003, and the Ninth Circuit in 2004. She serves on the Technology and Intellectual Property Committee of the Oregon Chapter of the AeA. She is a member of the Oregon Patent Law Association, the American Intellectual Property Law Association, and the Federal Bar Association. She has lectured on intellectual property law for the Oregon Bar Association.
Brenna’s goal is always to resolve her clients’ conflicts outside the courtroom, but recent courtroom successes include:
1. Smith & Nephew, Inc. and Dr. John O. Hayhurst v. Arthrex, District of Oregon: obtained a verdict of willful patent infringement on behalf of plaintiffs.
2. Phase Four Industries, Inc. v. Marathon Coach, Inc., Northern District of California: after successful Markman and summary judgment proceedings, obtained a favorable settlement on behalf of Marathon Coach, the patent holder.
3. Tillamook Country Smoker, Inc. v. Tillamook County Creamery, District of Oregon: obtained summary judgment that Tillamook Creamery’s trademark claim was barred by laches and summary judgment that Tillamook Country Smoker is entitled to its trademark registration. Both decisions were upheld by the Ninth Circuit.
Brenna earned her Juris Doctor degree, Cum Laude, from Case Western Reserve University in 1999. She received a Bachelor of Arts degree with high honors in 1995, and a Bachelor of Science degree with honors in 2000 from Idaho State University.
Brenna enjoys motorcycling (she is a member of BMW Motorcycle Owners Association) and was a nationally ranked international competitor and second-degree black belt in Judo. Brenna has lived in Japan and Canada, speaks Spanish and Japanese.
